Terms of Service — Medi Transport Card

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Medi Transport Card mobile application ("App") and associated website (collectively, the "Service"), operated by Discover Claims LLC ("we," "us," or "our"). By accessing or using the Service, you confirm that you are at least 13 years old and agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Service.

2. Description of the Service

Medi Transport Card is a mobile application that allows users to create, preview, and print a wallet-sized medical transport preference card. The card documents a user's preferred and excluded medical facilities for use in emergency transport situations. The Service is provided free of charge and is supported by optional advertising.

3. No Medical Advice

The Service does not provide medical advice. Medi Transport Card is an informational tool designed to help you document and communicate your preferences. It is not a substitute for professional medical advice, diagnosis, or treatment.

We make no representations or warranties that emergency medical service (EMS) providers, hospitals, or any other parties will honor the preferences documented on your card. Compliance with your documented preferences depends entirely on the policies and discretion of the responding personnel and facilities.

In any medical emergency, always call 911 or your local emergency number. Do not rely solely on a preference card to communicate urgent medical needs.

4. User Responsibilities

You are solely responsible for:

The accuracy and completeness of the information you enter into the App
Keeping your printed card up to date as your preferences change
Ensuring that any facility names or information you include are accurate
Communicating your preferences to family members, caregivers, and healthcare providers
Complying with all applicable laws in your jurisdiction

5. Acceptable Use

You agree not to use the Service to:

Enter false, misleading, or fraudulent information
Violate any applicable law or regulation
Transmit spam, harmful code, or malicious content through the feedback system
Interfere with or disrupt the integrity or performance of the Service
Attempt to gain unauthorized access to any part of the Service

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Discover Claims LLC. The App's name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Discover Claims LLC. You may not use such marks without our prior written permission.

The preference card content you create using the App belongs to you. We claim no ownership over the information you enter.

7. Third-Party Services

The Service may incorporate third-party services including:

Google Mobile Ads (AdMob) — for serving advertisements within the App
Google Play Services — for app distribution and crash reporting

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any printed card will be accepted or honored by any emergency services personnel or medical facility.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRANSCENDING DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, OR DEATH, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (WHICH MAY BE ZERO FOR FREE USERS).

10. Indemnification

You agree to defend, indemnify, and hold harmless Discover Claims LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising from your use of the Service or violation of these Terms.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, please stop using the Service.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
